7.  INDEMNITY

In consideration of your access to this Website, you agree to indemnify and hold harmless Velcro from and against any threatened or actual loss, liability, damages, costs and expenses (including reasonable attorneys’ fees) suffered or incurred by Velcro arising from your breach of the Website Terms or your negligent, wilful, fraudulent or unlawful act or omission in connection with your use of this Website.

8. WEBSTORE CONDITIONS AND TERMS OF SALE

Property and risk of loss or damage to the goods which are the subject matter of this contract of sale passes to Buyer, and Seller's liability as to delivery ceases upon delivery of said goods to carrier at shipping point in good condition, said carrier shall be deemed conclusively to be Buyer's agent. Buyer is under a dutly after receipt of goods to examine the same before use or application.

Buyer expressly agrees with Seller that there are no conditions or warranties either general, express, or implied by statute or otherwise other than that Seller will replace the quantity of product proved to be defective. Seller shall not be liable for any injury, loss or damage, direct or consequential, however caused, arising out of the use of or the inability to use the product. Buyer shall determine the suitability of the product for its intended use, and Buyer assumes all risk and liability whatsoever in connection therewith.

No claim of any kind whether as to goods delivered or for non delivery of goods, shall be greater in amount than the purchase price of the goods in respect of such claim and failure to give notice of claim within ninety (90) days from the date of delivery, or the date fixed for delivery, whichever last occurs, shall constitute a waiver by Buyer of all claims in respect of such goods. No charges or expenses incident to any claims will be allowed unless approved by an authorized representative of Seller. Goods shall not be returned to Seller without Seller's prior permission. No claim will be allowed after any portion of the goods have been treated or processed in any manner. Contact our customer service to make claims on potentially defective product.

Returns will be accepted within 30 days from the date of shipment providing the items are in re-sellable condition and in original un-opened packaging with receipt or packing slip. Return authorization and shipping instructions are required from our Customer Service Department. Shipping charges are non-refundable.

No liability shall result from delay in performance or non performance of this agreement, directly or indirectly caused by fire, explosion, accidents, flood, labour trouble or shortage, war, declared or undeclared, act of or authorization by any Government, inability to obtain suitable material, fuel, equipment, transportation, or act of God or arising from contingencies, happenings, or causes beyond control of the Seller. The Parties' obligations respecting quantities of goods affected by any such circumstances may, at Seller's option, be terminated without liability, but in event of such termination this contract shall in all other respects, remain unaffected.

This contract shall in all respects be governed by the laws of the Province of Ontario.

This instrument contains all the terms, conditions and representations with respect to the sale and purchase of the goods described therein and no terms, conditions, representations or warranties shall have any force and effect unless contained herein.
